By accessing or using CapyBank services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services. We reserve the right to update these terms at any time, and continued use constitutes acceptance of changes.

2. Description of Services

CapyBank provides digital banking services including checking accounts, transfers, payments, and related financial tools designed for founders and small businesses. Services are provided through our website, mobile applications, and API.

3. Account Registration

To use CapyBank, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old and a legal resident of a supported jurisdiction.

4. Payments & Fees

CapyBank offers transparent pricing with no hidden fees. Current fee schedules are available on our pricing page. We reserve the right to modify fees with 30 days notice. You authorize us to debit applicable fees from your account.

5. Termination

You may close your account at any time by contacting support. CapyBank may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if required by law. Upon termination, remaining funds will be returned to you via the method of your choosing.

6. Limitation of Liability

To the maximum extent permitted by law, CapyBank shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the fees you have paid to CapyBank in the 12 months preceding the claim.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California.
